We undertake all forms of real property work and are regularly instructed in disputes concerning restrictive covenants, easements, boundary disputes, adverse possession, co-ownership, trusts of land, proprietary estoppel, implied trusts, options and rights of pre-emption and mortgages.
Landlord and Tenant
Chambers has strong expertise in the field of landlord and tenant and we are instructed in disputes relating to commercial, residential and agricultural land. Our members regularly act in cases involving disrepair, forfeiture, leasehold enfranchisement, service charges, and renewal of business tenancies.
Members of Chambers are frequently instructed by local authorities, housing associations and individuals in housing cases. Our work includes possession proceedings, homelessness appeals, housing benefit, right to buy and anti-social behaviour orders and injunctions.
Trusts and Probate
We are instructed in contentious work. Members regularly act in cases involving trusts of land, constructive trusts, claims under the Inheritance (Provision for Family and Dependants) Act 1975, the construction and validity of wills, the administration of estates, disputes between personal representatives beneficiaries and third parties and general trust litigation.
Other Property Related Claims
We undertake all forms of claims in tort relating to land, particularly those involving issues of nuisance, professional negligence, public liability and statutory duty. These include interference with property rights, pollution and environmental claims, geotechnical surveys and disputes relating to the contamination of land.
